Terms of Service

These Terms of Service (“Terms”) govern your use of the website k94realestate.com (the “Site”) and any photography, videography, or related services (the “Services”) provided by K94 Production LLC (“K94”, “we”, “us”), an Illinois limited liability company with its principal place of business in Roselle, IL 60172, USA. By booking a Service or using the Site, you agree to these Terms.

1. Services

K94 provides real estate photography, videography, drone aerial photography, virtual tours, twilight photography, and virtual staging services. Specific scope (number of photos, video length, deliverables, turnaround) is defined by the package you select at booking. Current packages and pricing are listed on the Site.

2. Booking and payment

• Bookings are confirmed once you submit the booking form and we acknowledge receipt by phone, email, or SMS.
• Payment is processed by Stripe in U.S. dollars. By submitting payment you authorize K94 to charge the amount shown to the payment method you provide.
• Prices are subject to change; the price quoted at booking is the price you pay for that booking.
• Sales tax (if applicable) will be added at checkout.

3. Rescheduling, cancellation, and refunds

• Reschedule — free of charge if requested at least 24 hours before the scheduled shoot.
• Cancellation — full refund if cancelled at least 24 hours before the scheduled shoot. Cancellations within 24 hours forfeit a $50 trip-fee deposit; the remainder is refunded.
• Weather — if outdoor or drone elements are not feasible due to weather, we will reschedule those elements at no additional cost.
• Quality guarantee — if final deliverables do not match the agreed scope, we will reshoot the affected portions at no additional cost.

4. Property access and safety

You must provide safe and lawful access to the property at the scheduled time. You confirm that you are authorized (as owner, listing agent, property manager, or designated representative) to permit photography and publication of the property images. K94 is not liable for delays, missed shoots, or extra fees resulting from inability to access the property at the scheduled time.

5. Intellectual property and licensing

• K94 retains the copyright to all photographs, videos, and other media produced under these Terms.
• Upon full payment, K94 grants you a non-exclusive, royalty-free, perpetual license to use the deliverables for the marketing, sale, or rental of the specific property photographed, including MLS listings, social media, and your own website.
• Resale, sublicensing to third parties, or use unrelated to the listed property requires written permission from K94.
• K94 reserves the right to use the deliverables in its own portfolio, website, and marketing.

6. Drone operations

All drone flights are operated by an FAA-licensed Part 107 remote pilot in accordance with applicable FAA, state, and local regulations. K94 will not operate the drone in conditions or locations that are unsafe or unlawful (e.g., restricted airspace without authorization, dangerous weather).

7. Disclaimer and limitation of liability

The Services and Site are provided “as is” without warranties of any kind except those that cannot be excluded under Illinois law. K94's total liability for any claim arising out of or related to the Services is limited to the amount you paid for the specific Service giving rise to the claim. K94 is not liable for indirect, incidental, consequential, or punitive damages.

8. Governing law and disputes

These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-law principles. The exclusive venue for any dispute is the state or federal courts located in DuPage County, Illinois.

9. Changes to these Terms

We may update these Terms from time to time. Bookings made after a revision are governed by the then-current Terms. Material changes will be posted on this page with an updated “Last updated” date.
